What to Expect at a Real Estate Closing in Tennessee

Preparing to buy or sell in Tennessee? Learn what happens before, during, and after closing, what to bring, and how to protect your closing funds.

A real estate closing in Tennessee is the final stage of a property purchase, but much of the work happens before anyone sits down to sign. Title review, lender requirements, closing figures, and document preparation all help move the transaction toward completion.

Before closing day

Your closing team coordinates the information needed for your transaction. This may include the purchase agreement, title examination, mortgage payoff information, lender instructions, and documents needed to address title requirements.

Respond promptly to requests and let your coordinator know about special circumstances. A power of attorney, trust, business entity, or signing outside the office may require additional review. Confirm those arrangements before your appointment.

Review your closing figures

Buyers should review the purchase price, deposit credits, closing costs, and amount due. Sellers should review mortgage payoffs, expenses, prorations, and expected proceeds. Ask about any item you do not understand.

For most mortgage loans subject to federal Closing Disclosure requirements, the borrower must receive the Closing Disclosure at least three business days before loan consummation. Compare it with your Loan Estimate and ask your lender about differences. Cash purchases do not have this mortgage disclosure requirement.

Confirm what to bring and how to send funds

Bring a valid, unexpired government-issued photo ID and any other items your coordinator requests. Confirm who must attend, the appointment location, and the approved method and exact amount of funds due.

Understand the documents you sign

The documents depend on your role and whether the purchase is financed. The seller generally signs the deed transferring the property. A financed buyer typically signs a promissory note and a deed of trust, along with applicable disclosures and other lender documents.

The note describes the repayment obligation. The deed of trust secures the loan against the property. Take time to read your documents and ask questions before signing. If you need legal advice about your rights or obligations, arrange separate attorney assistance.

Know what title insurance protects

A lender’s title insurance policy protects the lender’s insured interest. It does not provide the buyer with the protection of an owner’s policy. An owner’s policy can protect the buyer against certain covered title risks, subject to the policy’s terms, exclusions, and exceptions.

Ask which policies will be issued and review the applicable title requirements and exceptions before closing.

After the signing appointment

Signing does not always mean that funds are immediately available or that possession begins that day. Completion may depend on lender authorization, receipt of funds, recording arrangements, and other transaction requirements.

Confirm when proceeds will be disbursed and when the buyer may take possession under the purchase agreement. Keep copies of your closing documents and retain your title insurance policy when it is issued.
